Description of Service
CoLo Creatives LC provides high-quality custom graphic design services to clients on a contract basis. The terms of any job are specified in the work contract and Scope of Work documents which the client and designer sign before work begins. The Designer will maintain a copy of the contract and scope of work for at least 3 years past project completion.
Refund/Cancellation
The Client or Designer may terminate the service at any time if, for any reason, the relationship is deemed unsatisfactory by either party. Upon written or verbal cancellation, Client is responsible for payment for all expenses incurred and any work done towards the completion of the project based on the percentage of the project completed as determined by Designer based on the written Scope of Work. Should Client cancel the project following its completion, Client is responsible for full payment as per the agreed upon estimate plus all expenses incurred. In the event of cancellation, Designer retains ownership of all copyrights for any original work created. Any initial deposit paid to begin work is non-refundable and will not be returned regardless of who canceled the job.
Force Majeure
CoLo Creatives LC shall be excused from any delay or failure in performance required hereunder if caused by reason of any occurrence or contingency beyond its reasonable control, including, but not limited to, acts of God, acts of war, fire, insurrection, strikes, lock-outs or other serious labor disputes, riots, earthquakes, floods, explosions or other acts of nature.
Limitation of Liability
The Client acknowledges and agrees that CoLo Creatives LC will not be liable for any losses or damages, whether indirect, incidental, special or consequential, in profits, goods or services, irrespective of whether or not the Client has been advised or otherwise might have anticipated the possibility of such loss or damage.
No Guarantee
The client acknowledges and agrees that CoLo Creatives LC cannot guarantee the results or effectiveness of any of the services rendered or to be rendered. Rather, services shall be executed in a professional manner and in accordance with good industry practice. Best efforts will be used but no results are promised.
